TERMS OF SERVICE
Welcome to Any Given Season Fantasy Sports ("Fantasy Football") (�Fantasy Golf�) (�Fantasy Basketball�), owned and operated by Razorhorns, LLC. Please read these terms of service before agreeing to compete in any fantasy sports provided by Razorhorns, LLC. To be clear, Razorhorns, LLC offers its fantasy sports service to you through its owned and operated website www.anygivenseason.com. Any participation in fantasy football provided by Razorhorns, LLC will be deemed as acceptance of the terms of service. If you do not agree with the terms of service, please do no participate in the fantasy sports provided by Razorhorns, LLC.
Your fee for signing up for the league of your choice gives you access to features of that specific package for the length of that given sports season. Your credit card will be billed for the fee of your choice. All references to currency are in US dollars. Your payment is non-refundable and cannot cancel your service before the end of the season.
Razorhorns, LLC reserves the right through its own discretion to terminate the service at any time for any reason without notice to you and provide you a refund for any fees you might have paid. If the service is terminated to you, you fully understand that Razorhorns, LLC only liability to you will be for the fees you have incurred by signing up and not for any other possible damages that may occur relating to your involvement in fantasy sports.
If (a) your credit card is invalid for any reason, (b) you charge back to your credit card the fees due under these Additional Terms, (c) it appears you have engaged in cheating or manipulation of the Service, or (d) Razorhorns, LLC believes you have acted in a manner inconsistent with the spirit or the letter of the TOS, your fantasy sports account may be suspended or cancelled immediately and all information contained within it immediately deleted or made inaccessible. Razorhorns, LLC may immediately terminate your access to the Service if it concludes that you have provided false information in connection with your registration data. Razorhorns, LLC accepts no liability for information that is deleted due to the termination of your account.
You fully understand that a league must consist of 100 teams before it is considered active and qualifies for prizes. If a league does not reach 100 teams by the end of week 7 of the regular season then all entries fees will be refunded.
All statistics and other information provided though the website, anygivenseason, are unofficial. All components are offered for informational or entertainment purposes only and Razorhorns, LLC will not be held liable for any errors or omissions in that information.
The fantasy sports provided are for entertainment purposes only and may not be used in connection with any form of gambling or wagering. Furthermore, you accept full responsibility for the amount of money you have paid to play fantasy sports and will not hold liable Razorhorns, LLC or its website anygivenseason.com for the amount of money you have delegated to playing fantasy sports. You also acknowledge that the only money you can lose is the amount of money that you put into playing fantasy sports. Furthermore, you understand that the payment of fees to play fantasy sports is not a guarantee that you will win a prize. Again, Razorhorns, LLC will not be responsible for your excessive payment of fees to play fantasy sports and any expenditure of money is at your own discretion and of your own responsibility. Razohorns, LLC reserves the right to cancel the services provided to you if we believe you are disrupting the service, pose a threat to other users, or exhibit violent behavior posed on message boards. Threatening behavior is not tolerated by Razorhorns, LLC and any user who threatens others, uses foul language, or poses a nuisance to others is at risk of losing their rights to the services provided by Razorhorns, LLC.
You agree to indemnify and hold harmless Razorhorns, LLC and its subsidiaries, affiliates, officers, agents, or other partners, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of, or participation in fantasy sports.
If any provision of these Additional Terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of such documents remain in full force and effect.
The Razorhorns, LLC Terms of Service, which apply to your use of fantasy sports provide that both you and Razorhorns, LLC agree to submit to the personal and exclusive jurisdiction of the courts located within Nevada, USA. Any controversy or claim arising out of or relating to these TOS and/or Razorhorns, LLC shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association and shall be held in the courts of Nevada, USA. The Razorhorns, LLC Terms of Service, these Additional Terms and the relationship between you and Razorhorns, LLC will be governed by the laws of the State of Nevada, without regard to its conflicts of law provisions. Any matters or proceedings not subject to arbitration will be held in the courts of Nevada. All cases will be arbitrated on an individual basis and cannot be combined or consolidated with any controversy or claim by any other party.
If you witness any user activity in Razorhorns, LLC fantasy sports that violates the Terms of Service, these Guidelines or the Razorhorns, LLC fantasy sports rules then please contact us. Razorhorns, LLC cannot guarantee that any action will be taken as a result of your email, but we appreciate your help in making the service a fun place for everyone.
Razorhorns, LLC reserves the right to amend these terms of service at any time without your notification.
You may not use our services for any manner that may be deemed unlawful or could cause harm to others as determined at our sole discretion.
It is your responsibility to provide updated, true, and accurate information about yourself.
You understand that anything you submit to Razorhorns, LLC websites by way of a message board may be routed through our servers and may be viewed on the Internet by the general public and you should have no expectation of privacy. The security of any information you provide on these message boards cannot be guaranteed. We do reserve the right to edit or delete any posting you may submit.
When on a Razorhorns, LLC site, their may be links that will redirect you to other sites. We take no responsibility for the information provided on these other sites.
It is your responsibility to keep your email and passwords secure as Razorhorns, LLC will not be responsibility for any unauthorized use of your email, password, or account.
Razorhorns, LLC does not claim to have ownership to any pictures, names, or team names provided on the site.
You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
Your account can only be used by one person, the multiple ownership of a login name is not allowed.
Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis. Razorhorns, LLC may, but has no obligation to remove content and accounts containing materials determined to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violate any party's intellectual property or these Terms of Service.
Razorhorns, LLC will not be responsible for any damage to your computer or hardware that may occur while on own websites. Furthermore, Razorhorns, LLC will not be held liable for the use of, the inability to use, or the performance of Razorhorns, LLC owned websites.
When you act on the features of any Razorhorns, LLC owned website, you act at your own risk.
Razorhorns, LLC assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service. In consideration of your use of the services, you represent that you are of legal age to form a binding contract and are not barred from receiving services under the laws of the United States or your state.
You agree not to upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
